Abstract: 

Con ipoteca ricaricabile si fa riferimento ad un diritto reale di garanzia di origine francese e che, proprio in Francia, è stato protagonista di una movimentata vicenda legislativa. A seguito dell’entrata in vigore della Loi 2014 – 1545, l’istituto viene regolato dall’art. 2422 del code civil e l’autore, nel contributo in esame, a seguito di una dettagliata descrizione del fitto dialogo tra giurisprudenza di legittimità e legislatore che ne ha segnato le sorti, ne descrive le principali caratteristiche, tra cui quella della costituzione: essa può essere costituita anche per crediti non ancora determinabili, a differenza dell’ipoteca in garanzia di crediti futuri. Dopo aver approfondito aspetti ulteriori come i meccanismi di funzionamento e l’estinzione, l’A. si sofferma su alcuni punti problematici che segnano l’istituto. Viene innanzitutto sottolineato come, sia la dottrina italiana che quella francese, lo ritengano derogatorio dei principi di accessorietà e specialità: il primo viene derogato con particolare riferimento alla vicenda della nullità delle clausole di ricarica e alla sopravvivenza della garanzia all’estinzione del credito; il secondo viene inciso sensibilmente rispetto alla particolare funzione “prenotativa” della ricaricabile, in quanto il costituente può assegnare in garanzia il proprio bene non solo per crediti determinati nell’atto costitutivo, bensì anche a favore di crediti eventuali nel momento di creazione del vincolo. 

 

With the term “rechargeable mortgage” we refer to a real security of French origin which has been in the middle of an eventful legislative affair, right in French legal system. After the entry into force of Law 2014 - 1545, rechargeable mortgage has been regulated by article 2422 of French civil code. The author, in this contribution, after a detailed description of the close dialogue between High Court case law and the Legislator, describes its main characteristics among which there is its enrollment: it can also be set up for not still determinable credits, unlike mortgages for future credits. After the deepening on further aspects as functioning mechanisms and the extinction, the author dwells on some problematic issues. First, it is underlined how both Italian and French doctrine consider rechargeable mortgage derogating from accessoriness and speciality’s principles: the first is waived with reference to the case of recharge clauses’ nullity and to security’s survival, despite the extinction of credit; the second is violated regarding to its particular reservation function, because who constitutes mortgage can guarantee his own good not just for determined credits at the moment of constitution act, but also for potential credits
