Finanza comportamentale e scenari probabilistici: brevi riflessioni sul KID

Abstract: 

L’autore, attraverso la visuale della finanzia comportamentale, analizza la disciplina dei PRIIPs (packaged retail investment and insurance based investment products), ed in particolare le disposizioni normative del Reg. UE 1286/2014 e Reg. del. UE 653/2017 (veicolate nell’ordinamento italiano dalla Delibera Consob 20250/2018 che ha introdotto il Capo IV-bis nel Reg. Consob 11971/1999) che riguardano il documento informativo precontrattuale che accompagna tali prodotti, il KID (key information document). Ad un’analisi critica delle scelte del regolatore europeo circa la conformazione “estetica” del KID, concentrata sull’impatto che tale conformazione ha sul potenziale investitore, segue un esame delle principali novità introdotte dal corpusnormativo succitato, in punto di disciplina del “tempo” della scelta di investimento nel PRIIP e di “revisione” del KID. L’autore, pur confidando nelle potenzialità della nuova disciplina, evidenzia il carattere imprescindibile della funzione “informativa” dell’intermediario finanziario, che dovrà, nel mutato scenario normativo, tra le altre cose, muoversi con perizia nella somministrazione di KID “adeguati” al singolo investitore.

 

The author, through the lens of behavioral finance, analyzes the discipline of PRIIPs (packaged retail investment and insurance based investment products), and in particular the regulatory provisions of EU Reg. 1286/2014 and Reg. EU 653/2017 (introduced in the Italian legal system by Consob Resolution 20250/2018 with the insertion of Chapter IV-bis in Consob Regulation 11971/1999) concerning the pre-contractual information document accompanying such products, the KID (key information document). A critical analysis of the choices made by the European regulator about the “aesthetic” conformation of the KID, focused on the impact that this conformation has on the potential investor, is followed by an examination of the main innovations introduced by the aforementioned regulatory body, in terms of the “time” for the investment choice and of “revision” of the KID. The author, while trusting in the potential of the new discipline, highlights the unavoidability of the advice of the financial intermediary, which, among other things, will have to move with expertise in providing an “adequate” KIDs to the single investor.
